CITY OF TERRYTOWN
COUNCIL MINUTES
The City of Terrytown Council met on Thursday, July 6, 2017, at 6:30 PM, for their regular monthly meeting at the Housing Authority, 89A Woodley Park Road in the City of Terrytown.  Notice of said meeting was published in the Scottsbluff Star-Herald according to law and council members were notified of said meeting.  The meeting was called to order at 6:30 p.m. by Mayor Kent Greenwalt.  Council Members present were:  Jerry Green, Chris Perales and Marcia Sherlock.  Absent: Cyinda Kriner.  Assistant City Clerk Tamera Leeling recorded the proceedings of the meeting. The minutes of the previous meeting were dispensed with.
The Pledge of Allegiance was recited by those in attendance.  Mayor Greenwalt pointed out the location of the poster for the Open Meetings Act.
There were no additions, changes, or emergency items added to the agenda.
There was no correspondence added to the agenda.
Moved by Sherlock and seconded by Perales to approve the minutes of June 1, 2017.  Aye’s:  Green, Perales and Sherlock.  Nay’s:  None.  Motion approved.
It was brought to the council's attention that of June's council meeting was only published seven days in advance. In order to ensure conformity with the city's ordinance on reasonable, advance publicized notice of regular council meetings requiring 10 days' notice, it was moved by Perales and seconded by Sherlock to ratify all action taken at the June 1, 2017 regular meeting.  Ayes:  Green, Perales and Sherlock.  Nay’s:  None.  Motion approved."

Moved by Sherlock and seconded by Perales to approve Green’s conflict of interest for the payment of Clerk Linda Green’s wages and to approve payment of Clerk Linda Green’s wages.  Aye’s:  Perales, Sherlock and Greenwalt.  Nay’s:  None.  Motion approved.

Mayor Greenwalt appointed Derek Manley, David Waggoner and Melvin Elledge to the City of Terrytown’s Planning Commission.
Scott Couch presented with council with an assessment of damage to his water softener and plumbing due a vacuum which built up within them.  It is his belief that this may have occurred as the result of water tower maintenance on June 26, 2017. The total cost of the water softener replacement and inspection was estimated to be $3,160.00. Moved by Perales and seconded by Green to submit claim to the City’s insurance carrier, League Association of Risk Management (LARM), for investigation.  Aye’s:  Green, Perales and Sherlock.  Nay’s:  None.  Motion approved.

Housing Partners of Western Nebraska requested holding a block party in front of Bluff View Apartments resulting in a street closure at the intersection of Woodley Park Road and the intersection of Gary Street on July 7, 2017, from 4:15 p.m. to 6:30 p.m.  Moved by Green and seconded by Sherlock to approve and allow the block party once stipulation of notification of emergency services including law enforcement, fire department and EMS is completed by noon on date of block party and verification of notification is provided.  Aye’s:  Green, Perales and Sherlock.  Nay’s:  None.  Motion approved.  
Panhandle Public Health District Health Educator Janelle Hansen explained that they are one of six health districts across that state to receive a grant for chronic disease prevention.  The grant seeks to promote more walk-ability, more bike-ability and transport throughout the area.  The Panhandle Public Health District requested that the City of Terrytown join the cities of Scottsbluff and Gering in adopting a resolution to establish an active living advisory committee.  This Active Living Advisory Committee will be commissioned by the tri-cities to provide community input and recommendations as to the City’s development and design that promotes active living.  Moved by Green and seconded by Sherlock to approve Resolution 17-3 Establishment of Active Living Advisory Committee.  Aye’s:  Green, Perales and Sherlock.  Nay’s:  None.  Motion approved.

RESOLUTION NO. 17-3
A RESOLUTION OF THE MAYOR AND COUNCIL OF THE CITY OF TERRYTOWN, NEBRASKA:
Establishment of Active Living Advisory Committee

PURPOSE:
To provide a forum for community collaboration and input to the tri-cities of Scottsbluff, Gering, and Terrytown: Public Works, Parks and Recreation Departments, Law Enforcement, other city staff, and Elected Officials about “active living” community development and design principles. Active living is a way of life and a community culture that integrates physical activity into daily routines through transportation, recreation, and neighborhood choices that support walking, biking, active play, and healthy options for all abilities and ages. The committee supports the tri-city’s ongoing efforts to improve sidewalks and intersections, calm traffic, and expand the network of bike routes and walking trails and stands ready to serve as a resource and liaison among all groups seeking input and diversified group representation.

POLICY:
It is the policy of the Scottsbluff, Gering, and Terrytown communities to seek community input into policies and projects that support healthy and active behaviors and lifestyles. To that end, this Active Living Advisory Committee is commissioned by the tri-cities to provide community input and recommendations as to City development and design that promote active living.

SELECTION AND TERM OF COMMISSION MEMBERS:
Committee will consist of members representing broad segments of the community with expertise and interest in active living community design, public health, health care, and multi-modal transportation, including biking, walking, and transit. Geographically diversified community representatives will be appointed by each of the three city councils for a total of eight-an ideal makeup of three from Scottsbluff, three from Gering, and two from Terrytown, with the allowance that this combination may not always be possible. A representative from City Planning, Public Works, Parks and Recreation, Public Safety, or Law Enforcement shall serve on the Committee. The Committee shall establish such bylaws, rules, procedures, terms, offices, and reporting as are necessary for the Committee to serve the function identified.

EFFECTIVE DATE:
The Active Living Advisory Committee shall be effective on the signing of this resolution.

OVERSIGHT:
  • The City Planning Departments will have responsibility for oversight and support of this committee with Panhandle Public Health District charged with the overall coordination of the meetings and meeting minutes. Meeting minutes will be provided to each of the city councils reporting continuous committee progress.

Regularly Scheduled Meetings: Monthly, dates and times to be determined by the group


Responsibilities Include:
  • Active Living Advisory Committee members are appointed by city council members from Scottsbluff, Gering, and Terrytown communities to serve as advocates and advisors to the tri-cities on projects and programs that help citizens safely incorporate physical activity into their daily routines. 
  • The committee is charged with:
    • Moving the Action Planning work product strategies to fruition:
      • Safe Active Transportation on All Travel Ways
      • Creating Collaborative Community Ownership
      • Complete Streets: Planning for a Safer, More Connected, Healthier Community
      • Seeking Funding Opportunities

  • Assisting city staff with public education and outreach activities that promote active transportation and an active lifestyle
  • Supporting wellness and health promotion in workplaces, schools, and other institutions
  • Assisting city staff with outreach to specific user groups, such as seniors, teens, the physically disabled, vulnerable and diverse populations to encourage an active lifestyle

City Attorney Libby Stobel discussed the Professional Retail Operations Agreement between Nebraska Public Power District and the City of Terrytown.  This agreement would extend service with Nebraska Public Power District for a term not less than fifteen years and not more than twenty-five years.  More information will be provided by an NPPD representative at the August 2017 city council meeting.

City Engineer Jeff Wolfe provided an update on the water project.  Hennings Construction will begin construction on August 15, 2017, at the intersection housing the vaults.  Looped water lines will improve the water lines in the Bellevue area. Upon completion of the water project, the City will be using Gering’s water tower and Terrytown’s water tower will be took out of service.     

City Engineer Jeff Wolfe reported on the proposed property acquisition from Terry Carpenter, Inc. (“TCI”).  Special Attorney Jim Ellison sent a letter extending an offer of $75,000.00 for all of the desired parcels to TCI’s attorney.  Also included in the letter was a conservative summary of the City’s expenses for Terry’s Lake over the past twenty years that the City has incurred resulting in over $800,000.00.  
City Engineer Jeff Wolfe reviewed the pending Terrytown Storm Water Management Program.  The City of Scottsbluff has develop a map of city-owned properties and Mr. Wolfe is working on developing a plan for disposal of storm water.  The cities of Gering and Terrytown will share a plan and within twelve months this plan should be presented for approval.  The City of Scottsbluff will modify their existing storm water management plan.  The City of Scottsbluff will take the lead in providing continued education through a web-site and a community education program.  All three cities plan to charge the same amount for the surcharge to be consistent.  
City Administrator/Treasurer Lonnie Miller presented the May 2017 Financial Statements.    
City Administrator/Treasurer Lonnie Miller explained that the City’s budget needs to be submitted to the state by September 20, 2017.  A budget hearing was scheduled for Thursday, September 7, 2017.  A budget workshop is planned for Thursday, August 10, 2017, at 6:30 p.m. at the Housing Authority, 89A Woodley Park Road in the City of Terrytown.  Notice of said meeting will be published in the Scottsbluff Star-Herald.

City Administrator/Treasurer Lonnie Miller proposed the purchase of a new time clock recorder for the City’s maintenance shop to replace the existing machine.  The current machine is no longer operational.  Mr. Miller proposed the purchase of the Lathem 2101 Manual Clock Time Recorder from Moneywise Office Supply for $349.33 including free shipping.  This machine is similar to the current machine and is compatible with the time cards on hand.  Moved by Sherlock and seconded by Perales to purchase the Lathem 2101 Manual Clock Time Recorder from Moneywise Office Supply for $349.33 including free shipping.  Aye’s:  Green, Perales and Sherlock.  Nay’s:  None.  Motion approved.
Utility Supervisor Hugo Chairez presented a report on the maintenance activities.  In the past month there have been five water leaks requiring repair.  The new speed signs have been installed on Terry Boulevard and the signage for the one-way streets on Woodley Park Road and Spring Valley Lane have been erected.
During the opportunity for public comment, Mike Minzey discussed the on-going feral cat problem at his residence and in his neighborhood.  The city will loan a cat trap to Mr. Minzey and the Panhandle Human Society will be advised.
There being no further business to come before the Council, moved by Sherlock and seconded by Green to adjourn to the next called meeting on Thursday, August 3, at 6:30 PM, subject to the call of the Mayor.  Aye’s:  Green, Perales and Sherlock.  Nay’s:  None.  Motion approved.
