COUNCIL MINUTES The City of Terrytown Council met on Thursday, December 6, 2018, at 6:30 PM, for their regular meeting at the Housing Partners of Western Nebraska Community Room, 89A Woodley Park Road in the City of Terrytown. Notice of said meeting was published in the Scottsbluff Star-Herald according to law and council members were notified of said meeting. The meeting was called to order at 6:30 PM by Mayor Kent Greenwalt. Council Members present were: Tyler Feil, Chris Perales and Marcia Sherlock. Absent: Jerry Green. City Clerk Tamera Leeling recorded the proceedings of the meeting. The Pledge of Allegiance was recited by those in attendance. Mayor Greenwalt pointed out the location of the poster for the Open Meetings Act. Mayor-Elect Chris Perales presented Mayor Kent Greenwalt with a plaque from the Terrytown City Council and Terrytown employees for his years of service from 2006 to 2018. City Administrator/Treasurer Lonnie Miller read correspondence received from prior Chairman of the Village of Terrytown Board Glenn Hascall. Mayor Kent Greenwalt was granted time to speak and reflected on his years on the Terrytown City Council. There being no further business to come before the outgoing Council, moved by Sherlock and seconded by Feil to adjourn. Aye’s: Feil, Perales and Sherlock. Nay’s: None. Motion approved. City Clerk Tamera Leeling administered the oath of office to Mayor-Elect Chris Perales, Council Member-Elect Tyler Feil and Council Member-Elect Michael Minzey. Council Members present were: Tyler Feil, Michael Minzey, Chris Perales and Marcia Sherlock. Absent: None. City Clerk Tamera Leeling recorded the proceedings of the meeting. The minutes of the previous meeting were dispensed with. There were no additions, changes, or emergency items added to the agenda. A public hearing was held on TD Relka LLC d/b/a Sizzlin’ Sirloin Steakhouse’s request for a Nebraska Retail Class CK Liquor License. Tammy Relka has leased the building located at 3745 North 10th Street in Terrytown and plans to open a family-friendly restaurant/bar in March or April and would like to have Keno. Ms. Relka currently owns and operates the Flight Deck Restaurant in Scottsbluff and will operate both business. Ms. Relka advised that she has held a liquor license for the past six years in the capacity as owner and previously held liquor licenses in the capacity of manager for approximately seven years. City Attorney Libby Stobel advised that she has discussed this matter with Chief of Police Kevin Spencer and reviewed Ms. Relka’s liquor license application and the memorandum from Chief Spencer was included in the council members’ packet. Ms. Stobel reported that Ms. Relka has held liquor licenses in the past, without violations, has completed the Responsible Beverage Service Training, and background checks do not personal history of alcohol abuse. Ms. Relka also has a policy in place for her employees to check identification on anyone that appears to be under the age of 40 and that her staff will complete the Responsible Beverage Service Training. Ms. Stobel recommends positive recommendation for TD Relka LLC d/b/a Sizzlin’ Sirloin Steakhouse Retail Class CK Liquor License be made to the Nebraska Liquor Control Commission. There being no public comment, the public hearing was closed by Mayor Perales. Owner Marcus Linn of Symmetry Brand Entertainment d/b/a Heaven addressed the council regarding an extension of liquor sales hours in Terrytown. Mr. Linn leases the building located at 3765 North 10th Street in Terrytown which is an event center that specializes in music and comedian entertainment as well as being available to rent out for other activities. Mr. Linn has applied to obtain a liquor license for his business. The cities of Scottsbluff, Gering and Terrytown require that liquor sales cease at 1:00 a.m. Mr. Linn is inquiring about the feasibility of Terrytown extending its liquor sales hours until 2:00 a.m. City Attorney, Libby Stobel stated that she would oppose such a change, as it could lead to an influx in intoxicated drivers to Terrytown after bars in Scottsbluff and Gering have closed, and put strain on the police department during this time. She further stated that should the council desire to consider this matter more seriously, she would recommend a public hearing. Moved by Sherlock and seconded by Feil to table this item to a later date after more investigation and recommended a public hearing on this matter to gain public input. City Clerk Tamera Leeling explained that the minutes have been amended since being published in the Scottsbluff Star-Herald. At the request of Animal Control Officer Virginia Klemm, a clarification was made on the Panhandle Humane Society’s report that was presented at the November 1, 2018 meeting. Also, Ms. Leeling advised that direct deposit claims that were not included in the regular claims for the November 1, 2018 meeting were added. Mayor Perales declared a vacancy for his former position as Terrytown City Council Member for Ward II due to his being elected mayor. This seat will be filled at the next regular meeting on Thursday, January 3, 2019, at 6:30 PM at the Community Room at the Housing Authority at 89A Woodley Park Road in the City of Terrytown. This term shall expire on December 31, 2020. The City will be accepting letters of interest from qualified, registered voters interested in being appointed to the City Council. Letters need to include address and telephone number and must be received by the City Clerk by 5:00 p.m. on Friday, December 21, 2018. An election of Council President was conducted and Tyler Feil nominated Marcia Sherlock. Moved by Feil and seconded by Minzey to close nominations and elect Marcia Sherlock as Council President. City Administrator/Treasurer Lonnie Miller reviewed the October 31, 2018 Financial Statements. Financial Statements are available for public inspection at the office of the City Clerk. Moved by Minzey and seconded by Sherlock to approve Mayor Chris Perales as an authorized person on the checking accounts, certificates of deposit, credit card and the safe deposit box with Platte Valley Bank. City Administrator/Treasurer Lonnie Miller recommended that the picnic shelter located at Hascall Park be dedicated to Mayor Kent Greenwalt for his years of service to the City and be named the “Greenwalt Shelter”. Mr. Miller also requested approval of a sign to be constructed by Utilities Supervisor Hugo Chairez. Mr. Chairez has constructed all of the signs throughout the lake so the shelter sign would carry the same theme and the estimated would be approximately $500.00. Moved by Sherlock and seconded Feil to approve Hugo Chairez to construct the shelter sign for approximately $500.00. Aye’s: Feil, Minzey and Sherlock. Nay’s: None. Motion approved. City Administrator/Treasurer Lonnie Miller explained that in the event that Mayor Chris Perales’s schedule does not permit, Kent Greenwalt has offered to attend meetings as a representative of Terrytown. Mr. Greenwalt is requesting to be reimbursed for mileage to attend these meetings. Reimbursement would be at the current Internal Revenue Service’s rate of 54.5 cents per mile. Moved by Sherlock and seconded by Feil to reimburse Kent Greenwalt mileage to attend meetings as a representative of the City of Terrytown. Aye’s: Feil, Minzey and Sherlock. Nay’s: None. City Administrator/Treasurer Lonnie Miller explained that during the budget process it was discussed as part of the employees’ compensation to include a $100.00 per employee year-end compensation amount. Mr. Miller suggested that a Year-End Employee Performance Incentive Award in the amount of $100.00 be given to all three City employees. The Year-End Performance Incentive Award would be based on the employees’ sick leave usage effective on their anniversary dates which ran from October to September for Tamera Leeling and Dennis McLaughlin and July to June for Hugo Chairez. Attendance records indicated that the employees’ usage was well under the national average. Mr. Miller recommended that all three employees be awarded $100.00 each. Moved by Minzey and seconded by Sherlock to compensate each employee $100.00 as a Year-End Performance Incentive Award. Aye’s: Feil, Minzey and Sherlock. Nay’s: None. Motion approved. City Engineer Jeff Wolfe presented the annual financial report for the street department for approval which is a requirement by the State of Nebraska to be eligible for state allocation. Moved by Feil and seconded by Sherlock to approve the annual financial report for the Mayor’s signature on the 2018 Terrytown Street Department Report. Aye’s: Feil, Minzey and Sherlock. Nay’s: None. City Engineer Jeff Wolfe requested that the council consider Resolution No. 18-09 Concerning a Standardized System of Annual Report with the Board of Public Roads Classifications and Standards. This is a formal recognition of the annual report that will be submitted to the state. Moved by Sherlock to approve Resolution No. 18-09 Concerning a Standardized System of Annual Report with the Board of Public Roads Classifications and Standards with amendments and seconded by Minzey. RESOLUTION 18-09 WHEREAS, The Nebraska law requires that the City of Terrytown to prepare and file with the Board of Public Roads Classifications and Standards, a standardized system of annual reporting, for the City of Terrytown street resources; and WHEREAS, Such information must be submitted annually; and WHEREAS, City staff has prepared the standardized system of annual reporting information for the City of Terrytown street resources; and WHEREAS, The information was submitted to Council and examined by the City Council at a regular meeting conducted on December 6th, 2018; and WHEREAS, Council believes the information is appropriate and should be approved. NOW, THEREFORE, BE IT RESOLVED, by the Mayor and City Council of Terrytown, Nebraska, that the standardized system of annual reporting information for the City of Terrytown street resources prepared by the City of Terrytown Street Department is hereby approved and the City staff is authorized to forward the information to the Board of Public Roads Classifications and Standards. Chris Perales, Mayor Attest: Tammy Leeling, City Clerk (SEAL) City Engineer Jeff Wolfe reviewed the Street Projects for 2019 1-6 Year Street Program. It was recommended that the City postpone street improvements due to the water project, as portions of the roads will need to be torn up while the water project is in process. At this time, maintenance only and no new construction is recommended on the one-year side. A public hearing will be held at the next regular meeting on January 3, 2019 to gain public input. City Engineer Jeff Wolfe presented an update on the Medearis Sanitary Sewer Extension. At the June 2018 City Council Meeting, Bellevue Resident Jack Medearis addressed the City Council regarding an essential easement on his property needed to locate a loop for the water project. As compensation for these easements, Mr. Medearis requested that the City extend the sewer lines approximately 300 feet to the northwest to cover remaining lots owned by Mr. Medearis. The City approved the sewer extension in exchange for a permanent easement and the cost of this project to be funded from the City’s sewer fund. The sewer extension has been designed and submitted to the state. Mr. Wolfe requested that Council decide if a bid date to allow for contractors to be on board and possibly begin construction in the spring. Moved by Sherlock and seconded by Feil to authorize City Engineer Jeff Wolfe to set a bid date and to present bids to the council at a future meeting. Aye’s: Feil, Minzey and Sherlock. Nay’s: None. Motion approved. City Engineer Jeff Wolfe reported that only one bid was received for phases 2 and 3 of the Terrytown Water Project. Thewater project is divided into four phases. Phase 1-Gering Connections Project has been completed with the connection of the City’s water system to Gering. Phase 2-Internal Improvements Project includes the construction of water mains, valves, hydrants and services for various areas around the city. Paul Reed Construction’s bid was $1,188,494.79 for phase 2, while the engineer’s estimate was $783,552.00. Phase 3-Meter Project which consists of the installation of 540 water meters, services and appurtenances. Henning’s Construction submitted a bid of $1,089,031.00 to install the water meters while the engineer’s estimate was $881,860.00. The two bids were tabled at the November 1, 2018 council meeting to allow Mr. Wolfe time to negotiate with bidders for a better price. Negotiations resulted in deductions of $58,422.70 from Paul Reed Construction for the water main work and deductions of $14,530.00 from Henning’s Construction for the water meter installation. A cost overage of approximately $500,000.00 remains even with bonding in place. Based on discussions with the state, Mr. Wolfe recommends that the City award the projects, contingent on acceptance of the change orders and formal approval by the federal and state funding agencies. In order to reduce overages, Phase 4, refurbishing the water tower, may need to be eliminated, as Gering has sufficient storage capacity without use of Terrytown’s tower. Even if the water tower refurbishment is eliminated, the city still faces an approximate $156,000.00 deficit for the project. The decision on Phase 4 can be tabled to a later date after other funding sources are researched. Mr. Wolfe advised that he is confident that funding sources could cover that deficit, but that decision could not be made until February 2019. In the meantime, the state is asking the City to issue a letter to the USDA and the state guaranteeing the $156,000.00 additional funding if Rural Development cannot come up with funding. City Administrator/Treasurer Lonnie Miller advised that it would be prudent to lock in the cost before interest rates and cost of materials increase. A major portion of the additional funding would be in the form of a loan which the City would be obligated to paying off over the next 40 years. Moved by Sherlock and seconded by Feil to award the Terrytown Water Project Phase 2 bid to Paul Reed Construction contingent on the acceptance of the change order and approval of the bid pending funding agency approval. Aye’s: Feil, Minzey and Sherlock. Nay’s: None. Motion approved. City Attorney Libby Stobel discussed Board of Health violations by R & S Auto that include an accumulation of junk and tires. Ms. Stobel advised that at least two letters have been sent to R & S Auto in the past twelve months and more letters have been sent in the past with no corrective action taken. Ms. Stobel requested direction from the council such as possible prosecution. Moved by Minzey and seconded by Sherlock to table this agenda item to the next regular meeting on January 3, 2019. A Code Enforcement Officer Committee meeting was held on December 6, 2018 to discuss a possible job description, time frame and hours expected to work. The Code Enforcement Office Committee consists of City Administrator/Treasurer Lonnie Miller, City Attorney Libby Stobel, Utilities Supervisor Hugo Chairez, City Clerk Tammy Leeling and Council Member Tyler Feil. Ms. Stobel explained that a replacement for Council Member Jerry Green was needed since Mr. Green was not re-elected to his position. Council Member Marcia Sherlock volunteered to serve on the committee. City Attorney Libby Stobel discussed the approval of TD Relka LLC d/b/a Sizzlin’ Sirloin Steakhouse request for a Retail Class CK Liquor License. Ms. Stobel conferred on the matter with Scottsbluff Police Chief Kevin Spencer and advised that Ms. Relka’s background checks have not revealed any alcohol-related offenses, and her servers must complete the Responsible Beverage Service Training. She also advised that she has a policy to check identification on anyone that appears to be under the age of 40. The establishment will have two digital calendars to help employees determine age and will require all employees to take the Responsible Beverage Service Training. Ms. Stobel and Chief Spencer recommend Ms. Relka’s request be granted. Moved by Sherlock and seconded by Feil to grant TD Relka LLC d/b/a Sizzlin’ Sirloin Steakhouse a Retail Class CK Liquor License. Panhandle Humane Society Animal Control Representative/Senior Kennel Tech Virginia (Ginger) Klemm reported that several complaints have been received about dogs at large. A total of 14 animals (13 cats and 1 dog) were received: 1 cat and 1 dog were adoptable; 5 cats were sick; 7 cats were feral. During public comment, multiple citizens were concerned about the rate of speed that the Road Runner buses were traveling through Terrytown. It was requested that Ms. Stobel refer the matter to Chief Spencer for assistance. There being no further business to come before the Council, moved by Sherlock and seconded by Feil to adjourn to the next called meeting on Thursday, January 3, 2019, at 6:30 PM, subject to the call of the Mayor.
