COUNCIL MINUTES
THE CITY OF TERRYTOWN MET ON THURSDAY, NOVEMBER 3, 2016 FOR THEIR REGULAR MONTHLY MEETING, AT THE HOUSING AUTHORITY AT 89A WOODLEY PARK ROAD IN THE CITY OF TERRYTOWN. NOTICE OF SAID MEETING WAS PUBLISHED IN THE GERING CITIZEN THE MEETING WAS CALLED TO ORDER AT 6:30 PM BY MAYOR KENT GREENWALT.  COUNCIL MEMBERS PRESENT WERE: JERRY GREEN, CHRIS PERALES AND MARCIA SHERLOCK.  CITY CLERK LINDA GREEN RECORDED THE PROCEEDINGS OF THE MEETING.  THREE READINGS OF THE MEETING WERE DISPENSED WITH.
THE PLEDGE OF ALLEGIANCE WAS RECITED BY THOSE IN ATTENDANCE.  MAYOR GREENWALT POINTED OUT THE LOCATION OF THE POSTER FOR THE OPEN MEETINGS ACT.
IT WAS MOVED BY GREEN AND SECONDED BY PERALES TO AMEND THE AGENDA FOR THE PUBLIC HEARING ON THE LIQUOR LICENSE REQUEST BY THE BOWL ARENA (DIANA UNTERSEHER).  AYE’S: GREEN, PERALES, SHERLOCK AND GREENWALT.  NAY’S: NONE.  MOTION WAS APPROVED.
THE PUBLIC HEARING FOR THE LIQUOR LICENSE REQUEST FOR THE BOWL ARENA WAS OPENED.  POLICE CHIEF KEVIN SPENCER REPORTED HE HAD CONDUCTED A BACK-GROUND CHECK ON THE MANAGER DIANA UNTERSEHER AND FOUND NO PROBLEMS.  THERE WERE NO FURTHER COMMENTS AND THE HEARING WAS CLOSED AT 6:40.
THERE WERE NO FURTHER ADDITIONS, CHANGES OR EMERGENCY ITEMS FOR THE AGENDA.
IT WAS MOVED BY SHERLOCK AND SECONDED BY PERALES TO APPROVE THE MINUTES OF THE OCTOBER 6, 2016 MEETING AS AMENDED BY CHANGING A RESOLUTION FROM 16-5 TO 16-6.  AYE’S: GREEN, PERALES, SHERLOCK AND GREENWALT.  NAY’S: NONE.  MOTION WAS APPROVED AS AMENDED.
THE NEXT ITEM ON THE AGENDA WAS PAYMENT OF THE CLERK’S WAGES. GREEN DECLARED HIMSELF IN CONFLICT OF INTEREST IN PAYMENT OF CHECKS: 14577-737.93, #14596- 696.77 AND #14598-406.34.  IT WAS MOVED BY PERALES AND SECONDED BY SHERLOCK TO APPROVE GREEN’S CONFLICT OF INTEREST FOR THE PAYMENT OF THE CLERK’S PAYCHECKS.  AYE’S: PERALES, SHERLOCK AND GREENWALT.  NAY’S: NONE.  MOTION WAS APPROVED.  IT WAS THEN MOVED BY PERALES AND SECONDED BY SHERLOCK TO APPROVE THE PAYMENT OF THE ABOVE-MENTIONED CHECKS.  AYE’S: PERALES, SHERLOCK AND GREENWALT.  NAY’S: NONE.  MOTION WAS APPROVED.

DIANA UNTERSEHER, D/B/A BOWL ARENA WAS IN ATTENDANCE FOR APPROVAL FROM THE COUNCIL REGARDING THE LIQUOR LICENSE REQUEST.  AFTER DISCUSSION IT WAS MOVED BY GREEN AND SECONDED BY SHERLOCK TO APPROVE THE LIQUOR LICENSE REQUEST.  AYE’S: GREEN, PERALES, SHERLOCK AND GREENWALT.  NAY’S: NONE.  MOTION WAS APPROVED.
BRYAN ARMSTRONG SUBMITTED HIS RESIGNATION TERMINATING HIS POSITION ON THE TERRYTOWN CITY COUNCIL, SINCE HE HAD MOVED IN OCTOBER 2016.  AFTER DISCUSSION IT WAS MOVED BY GREEN AND SECONDED BY SHERLOCK TO DECLARE A VACANCY ON THE COUNCIL AND PUBLISH NOTICE IN THE GERING CITIZEN OF THE VACANCY.  AYE’S: GREEN, PERAELS, SHBEGAN ERLOCK AND GREENWALT.  NAY’S: NONE.  A RECOMMENDATION WILL BE MADE BY MAYOR GREENWALT TO BE APPROVED AT THE DECEMBER 2016 COUNCIL MEETING.)
CITY ADMINISTRATOR/TREASURER LONNIE MILLER INTRODUCED THE NEW OFFICE MANAGER, TAMERA (TAMMY) LEELING TO THE COUNCIL.  MS. LEELING BEGAN WORKING ON OCTOBER 24TH, REPLACING LINDA GREEN, WHO IS RETIRING AT THE END OF THIS YEAR.

CITY ADMINISTRATOR/TREASURER LONNIE MILLER REPORTED THAT THE FINANCIAL STATEMENT FOR SEPTEMBER 2016 WILL BE REVIEWED AT THE DECEMBER 1, 2016 MEETING.  MR. MILLER THAN RECOMMENDED THAT COUNCIL APPROVE THE YEAR END TRANSFERS FOR THE FISCAL YEAR ENDING SEPTMEBER 30, 2016.  IT WAS MOVED BY PERALES AND SECONDED BY GREEN TO APPROVE THE TRANSFERS AS RECOMMENDED.  AYE’S: GREEN, PERALES, SHERLOCK AND GREENWALT.  NAY’S: NONE.  MOTION WAS APPROVEED.
ENGINEER MIKE OLSEN DISCUSSED AND REVIEWED ORDINANCE #436, CONCERNING THE RATES CHARGED FOR CITY-OWNED WATER AND SEWER UTILITIES.  THESE RATES HAVE BEEN GRADUALLY RAISED IN PAST YEARS TO PREPARE RESIDENTS TO THE RATES WHEN THE METERS ARE INSTALLED.
IT WAS MOVED BY GREEN AND SECONDED BY SHERLOCK TO WAIVE THE THREE READINGS OF ORDINANCE #436.  AYE’S: GREEN, PERALES, SHERLOCK AND GREENWALT.  NAY’S: NONE.  MOTION WAS APPROVED.
ORDINANCE NO. 436
AN ORDINANCE OF THE CITY OF TERRYTOWN, NEBRASKA, CONCERNING RATES CHARGED FOR CITY-OWNED WATER AND SEWER UTILITIES, REPEALING PRIOR ORDIANCES AND PROVIDING FOR AN EFFETIVE DATE.
 BE IT ORDAINED by the Mayor and City Council of the City of Terrytown, Nebraska:
1.       The City Council establishes water rates and sewer rates for all areas served by the city water and sewer system, both inside and outside the corporate limits of the City, as provided for in this Ordinance.  The rates provided for in this Ordinance shall be effective January 1, 2017.
2.       The city shall define as an occupied dwelling or mobile home as any dwelling or mobile home in which a person or persons dwell or reside for residential living or commercial occupation and an unoccupied swelling or mobile home as any dwelling or mobile home not currently occupied by a person or persons for any purpose  disconnection or reconnection of water or sewer service shall be in accordance with Ordinance No. 404 or any successor to that Ordinance.
3.       The following occupied dwelling or mobile home rates will prevail in service areas both inside and outside the corporate limits of the City of Terrytown:

4.       The following unoccupied dwelling or mobile home rates, which include unoccupied mobile home lots, will prevail in service areas both inside and outside the corporate limits of the City of Terrytown:

5.       All commercial water and sewer rates shall be as included in attached “Schedule of Commercial Water and Sewer Rates” which is marked as Exhibit “A” and incorporated by this reference.  Any successor occupants to the properties listed shall pay the rate as shown for the current or last occupant unless changed by ordinance.  Any Commercial establishment not shown on the attached Schedule shall pay the same rats as assessed for Single Family Dwellings.
6.       The rates for metered locations shall be as follows:
WATER:                  $2.94 per 1000 gallons
SEWER:                  $3.68 per 1000 gallons
7.       In addition to these base rates, the residents of Sanitary and Improvement District No 2, Scotts Bluff County, Nebraska shall pay an additional $15.00 for operation and maintenance fees (O&M) for the sanitary sewer mains through which the City supplies sanitary sewer services.
8.       Ordinance #434 and all other Ordinances or parts of Ordinances in conflict with this Ordinance will be repealed as of the effective date of the rates set by this Ordinance.
9.       This Ordinance shall take effect and be in force following its passage, approval and publication as required by law.

ENGINEER MIKE OLSEN DISCUSSED THE UPDATE OF THE WATER METER PROJECT.  THERE WAS A CHANGE IN THE WORDING OF THE WATER AGREEMENT BETWEEN THE CITY OF GERING AND THE CITY OF TERRYTOWN THAT NEEDED TO BE ADDRESSED AND THE AGREEMENT WILL NOW BE SIGNED BY BOTH ENTITIES.  THE INSTALLATION OF THE WATER LINE WILL BEGIN IN THE EARLY SPRING ON 2017 ALONG WITH THE BEGINNING OF THE INSTALLATION OF WATER METERS.  THE WATER TOWER SHOULD BE UPDATED IN 2018, TO COMPLETE THE PROJECT.
CITY ATTORNEY KENT HADENFELDT DISCUSSED AND REVIEWED ORDINANCE NO. 437, REQUIRING THE DISPLAYING OF HOUSING NJMBERS UPON EACH BUILDING WITHIN THE CITY OF TERRYTOWN .  IT WAS MOVED BY GREEN AND SECONDED BY SHERLOCK TO WAIVE THE READING OF ORDINANCE #437 ON 3 SEPARATE READINGS.  AYE’S: GREEN, PERALES, SHERLOCK AND GREENWALT.  NAY’S: NONE.  MOTION WAS APPROVED. 
ORDINANCE NO. 437
AN ORDINANCE OF THE CITY OF TERRYTOWN, NEBRASKA, REQUIRING THE DISPLAYING OF HOUSING NUMBERS UPON EACH BUILDING WITHIN THE CITY OF TERRYTOWN:
BE IT ORDAINED by the Mayor and City Council of the City of Terrytown, Nebraska:
1.            All residences,  storerooms, and other buildings facing on any street in the City shall be numbered.  Each number shall be displayed in a conspicuous place upon the residence, storeroom or other building to which the number has been assigned, or upon the curb in front of the premises, in figures not less than two and one-half (2 1/2) inches high and in accordance with any other standard specifications prescribed by the City Administrator or designee of the City Administrator.  It shall be the duty of the owner and the occupant of every residence, storeroom or other building to which a number has been assigned as provided in this Article to display such number in the manner provided in this section.

2.            This Ordinance shall take effect and be in force following its passage, approval and publication as required by law.

POLICE CHIEF KEVIN SPENCER REPORTED THAT THE SIGN HAD BEEN ORDERED FOR THE CITY, SHOWING THE SPEED LIMITS GOING IN EACH DIRECTION ON TERRY BLVD.  HE ALSO REPORTED THAY THE POLICE OFFICERS WERE PARTICIPATING IN NO SHAVING IN NOVEMBER THROUGH DECEMBER, ALONG WITH COFFEE WITH THE COPS ON NOVEMBER 11TH, AND SHOP WITH COPS ON DECEMBER 3RD.
THERE BEING NO FURTHER BUISNESS TO COME BEFORE THE COUNCIL, IT WAS MOVED BY GREEN AND SECONDED BY SHERLOCK TO ADJOURN TO THE NEXY CALLED MEETING ON THURSDAY, DECEMBER 1, 2016, SUBJECT TO THE CALL OF THE MAYOR.  AYE’S: GREEN, PERALES, SHERLOCK AND GREENWALT.  NAY’S: NONE.
