CITY OF TERRYTOWN
COUNCIL MINUTES
  
The City of Terrytown Council met on Thursday, October 4, 2018, at 6:30 PM, for their regular meeting at the Housing Partners of Western Nebraska Community Room, 89A Woodley Park Road in the City of Terrytown.  Notice of said meeting was published in the Scottsbluff Star-Herald according to law and council members were notified of said meeting.  The meeting was called to order at 6:30 PM by Mayor Kent Greenwalt.  Council Members present were:  Tyler Feil, Jerry Green, Chris Perales and Marcia Sherlock.  Absent: None.  City Clerk Tamera Leeling recorded the proceedings of the meeting. The minutes of the previous meeting were dispensed with.

The Pledge of Allegiance was recited by those in attendance.  Mayor Greenwalt pointed out the location of the poster for the Open Meetings Act.

There were no additions, changes, or emergency items added to the agenda.

Moved by Sherlock and seconded by Feil to approve the minutes of the regular meeting of September 6, 2018.   Aye’s:  Feil, Green, Perales and Sherlock.  Nay’s:  None.  Motion approved.

City Administrator/Treasurer Lonnie Miller reviewed the August 31, 2018 Financial Statements.  Financial Statements are available for public inspection at the office of the City Clerk. 
 
City Administrator/Treasurer Lonnie Miller recommended $80,000 be transferred from the electric fund to the general fund, $20,000 from the water fund to the general fund, $20,000 from the sewer fund to the general fund and $30,000 from the general fund to the street fund.  Moved by Sherlock and seconded by Green to approve the recommended cash transfers for the Fiscal Year ending on September 30, 2018.  Aye’s:  Feil, Green, Perales and Sherlock.  Nay’s:  None.  Motion approved.  
 
City Administrator/Treasurer Lonnie Miller proposed a compensation increase of approximately 4% for staff.  This would mean an increase of $0.75/hour for Utility Supervisor Hugo Chairez to a total of $19.00/hour, $0.50/hour for City Maintenance/Utility Worker Dennis McLaughlin for a total of $14.00/hour and $0.65/hour for City Clerk/Office Manager Tamera Leeling to a total of $17.80/hour effective with the next payroll on October 15, 2018.  Moved by Sherlock and seconded by Perales to approve the compensation increase for staff.  Aye’s:  Feil, Green, Perales and Sherlock.  Nay’s:  None.  Motion approved.   Mr. Miller also recommended that the city continue to contribute $2,500.00 to a Health Savings Account for each of the City’s three full-time employees.  A health savings account has been established at Platte Valley Bank in each employee’s name.  City contributions to the health savings account are tax free to employers and if the account is used for only medical expenses, it is not taxable to employees.  This matter will be tabled for a future city council meeting.
 
City Administrator/Treasurer Lonnie Miller explained that the League Association of Risk Management (LARM) recently conducted a loss control visit/administrative audit to identify specific risk management exposures.  LARM recommended the development of employee job descriptions to help employees understand their responsibilities and to assist in completing performance evaluations.  City Clerk Tammy Leeling obtained job descriptions from the Village of Morrill, City of Minatare and City of Crawford and compiled a job description for each of the three full-time employees and a seasonal employee.  A committee composed of the City Administrator, City Attorney, City Clerk and Mayor reviewed the drafts and suggested corrections were made.  The final documents were presented to council for approval.  Moved by Green and seconded by Sherlock to approve the job descriptions presented.  Aye’s:  Feil, Green, Perales and Sherlock.  Nay’s:  None.  Motion approved.
 
City Engineer Jeff Wolfe reported that the city has been notified by the state that approval has been granted to go out for bids on the metering phase of the water project.  This project consists of the installation of 540 water meters, services and appurtenances.  Also, bids will be accepted for the internal improvements phase which includes the construction of water mains, valves, hydrants and services for various areas around the city.  Separate sealed bids for the Terrytown Water System Phase 2: Internal Improvements Project and the Terrytown Water System Phrase 3:  Meter Project will be received by the City Clerk at the office of the City of Terrytown, 116 Terry Boulevard, Gering, Nebraska 69341 until 2:00 PM (local time) on October 30, 2018, and then at said office publicly opened and read aloud.  Bids will be presented to the council at the November meeting.  Once approved, the contracts will be signed and materials will be ordered with work projected to begin next year and will likely run until the spring of 2020.
 
City Engineer Jeff Wolfe presented an update on the replacement of the existing fuel tank for the back-up generator at the main sewer plant.  Utility Supervisor Hugo Chairez discovered that the current fuel tank had been leaking, possibly from rust.  It is necessary to have a fuel tank to operate the back-up generator in the event of a power outage.  Westco has replaced the fuel tank and Nebraska Machinery will sync the mechanism.   
 
City Engineer Jeff Wolfe discussed the Water Valve Operation Maintenance Program and presented the Valve/Hydrant Exercise Results Master Report.  M.C. Schaff & Associates has purchased equipment capable of leak detection, valve-exercising, hydrant flushing, hydrant flow testing, valve box vacuuming, mapping of the system, link to the GIS system and preventative maintenance.  Any valves determined to be non-functioning will be replaced.
City Attorney Libby Stobel discussed Ordinance No. 447 which adopts the budget statement to be termed the annual budget statement to be termed the annual appropriation bill to appropriate sums for necessary expenses and liabilities and to provide for an effective date.  Moved by Green and seconded by Sherlock to waive the three readings of Ordinance No. 447.  Aye’s:  Feil, Green, Perales and Sherlock.  Nay’s:  None.  Motion approved.  Moved by Sherlock and seconded by Perales to approve Ordinance No. 447 adopting the budget statement to be termed the annual appropriation bill to appropriate sums for necessary expenses and liabilities; to provide for an effective date.  Aye’s:  Feil, Green, Perales and Sherlock.  Nay’s:  None.  Motion approved.

ORDINANCE NO. 447
 
AN ORDINANCE OF THE CITY OF TERRYTOWN, NEBRASKA, ADOPTING THE BUDGET STATEMENT TO BE TERMED THE ANNUAL APPROPRIATION BILL TO APPROPRIATE SUMS FOR NECESSARY EXPENSES AND LIABILITIES; TO PROVIDE FOR AN EFFECTIVE DATE.
 
BE IT ORDAINED by the Mayor and City Council of the City of Terrytown, Nebraska:
  1. After complying with all procedures required by law, the budget presented and set forth in the Budget Statement as approved as the Annual Appropriation Bill for the fiscal year beginning October 1, 2018 through September 30, 2019. All sums of money contained in the Budget Statement are appropriated for the necessary expenses and liabilities of the City of Terrytown. The total expenditure for this purpose is $7,745,589.00. A copy of the budget document shall be forwarded, as provided by law, to the Auditor of Public Accounts, State Capitol, Lincoln, NE and to the County Clerk of Scotts Bluff County, Nebraska, for use by the levying authority.
  2. This Ordinance shall take effect and be in force following its passage, approval, and publication as required by law.

City Attorney Libby Stobel explained Resolution No. 18-7 that provides that the property tax request for the prior year shall be the property tax request for the current year for purposes of levies set by the County Board of Equalization.  Ms. Stobel also explained that a special public hearing was held on September 6, 2018, as required by law to hear and consider comments concerning the property tax request as well as an increase in the total restricted funds authority.  Ms. Stobel advised that it is in the best interest of the City that the property tax request for the current year be a different amount then the property tax request for the prior year and that the city increase the total restricted fund authority by 1%.  Moved by Sherlock and seconded by Green to approve Resolution No. 18-7.  Aye’s:  Feil, Green, Perales and Sherlock.  Nay’s:  None.  Motion approved.

 RESOLUTION NO. 18-7
 
WHEREAS, Neb. Rev. Stat. §77-1601.02, provides that the property tax request for the prior year shall be the property tax request for the current year for purposes of levies set by the County Board of Equalization unless the governing body of the City of Terrytown passes, by a majority vote, a resolution setting the tax request at a different amount, in addition the City of Terrytown must take action to increase the total restricted funds authority; and
 
WHEREAS, a special public hearing on September 6, 2018 was held at 6:30 p.m. as required by law to hear and consider comments concerning the property tax request as well as an increase in the total restricted funds authority; and
 
WHEREAS, it is in the best interest of the City of Terrytown that the property tax request for the current year be a different amount then the property tax request for the prior year and the City of Terrytown increase the total restricted funds authority by 1%. 
 
NOW, THEREFORE, the City Council for the City of Terrytown, by a majority vote, resolves the following:
 
  1. The 2018-2019 property tax request be set at $109,585.00.
 
  1. The City has determined they should increase the total restricted funds authority by 1% for the fiscal year beginning October 1, 2018 and ending on September 30, 2019.
 
  1. A copy of this Resolution be certified and forwarded to the County Clerk on or before October 1, 2018.
 
This Resolution shall become effective upon its passage and approval.

During the opportunity for Public Comment, Resident Lacie Ybarra complained about dogs barking in the neighborhood.  Ms. Ybarra has contacted the Scottsbluff Police Department and the Panhandle Humane Society but was advised that no ordinance is in place for this issue.  City Attorney Libby Stobel advised that this problem is considered a nuisance and the city has an ordinance that addresses this concern.  Ms. Stobel will contact the Scottsbluff Police Department and the Panhandle Humane Society to try to resolve this issue.
During the opportunity for Public Comment, Resident Mike Minzey advised that he serves as the city’s representative on the Active Living Advisory Committee.  This committee seeks to promote more walk-ability, more bike-ability and transport throughout the area.  Mr. Minzey was contacted by a film company that is filming across Nebraska to encourage walking and cycling.  Mr. Minzey was interviewed in an area of Hascall Park that highlights the Monument Pathway, Terry’s Lake and Scotts Bluff National Monument.  This film, “Good Life Health”, will appear on Nebraska Educational Television (NET) either the end of October or the beginning of November.

During the opportunity for Public Comment, Resident Tom Blackos voiced a concern about speed limits in Patriot Park.  Mr. Blackos also reported that Patriot Parks has established new lease agreements with its tenants that addressed no new dogs allowed and fire prohibited within the mobile home park. 

There being no further business to come before the Council, moved by Sherlock and seconded by Green to adjourn to the next called meeting on Thursday, November 1, 2018, at 6:30 PM, subject to the call of the Mayor.  Aye’s:  Feil, Green, Perales and Sherlock.  Nay’s:  None.  Motion approved.
