COUNCIL MINUTES The City of Terrytown Council met on Thursday, July 11, 2019, at 6:30 PM, for their regular meeting at the Housing Partners of Western Nebraska Community Room, 89A Woodley Park Road in the City of Terrytown. Notice of said meeting was published in the Scottsbluff Star-Herald according to law and council members were notified of said meeting. The meeting was called to order at 6:30 PM by Mayor Chris Perales. Council Members present were: Tyler Feil, Jerry Green, Michael Minzey, Chris Perales and Marcia Sherlock. Absent: None. City Clerk Tamera Leeling recorded the proceedings of the meeting. The minutes of the previous meeting were dispensed with. The Pledge of Allegiance was recited by those in attendance. Mayor Perales pointed out the location of the poster for the Open Meetings Act. There were no additions, changes, or emergency items added to the agenda. Terrytown Resident Kayla Gasker addressed the council regarding feeding of the Canadian geese at Terry’s Lake. Ms. Gasker advised that individuals have been feeding the geese on a regular basis. Ms. Gasker explained that the geese are divided into two classifications – resident and migratory. Resident geese can become a nuisance and cause overgrazing of lawns, create excessive feces droppings on playgrounds and pathways and affect water quality. Ms. Gasker requested that the City consider adopting an ordinance to address these concerns. Terrytown Resident Brian Nielsen advised that he had contacted the Nebraska Game & Parks in the past and they have monitored the situation and recommend that feeding of the geese cease. Police Chief Kevin Spencer advised that he is unaware of any ordinances in Scottsbluff. Mayor Chris Perales suggested that this item be tabled until the August 2019 city council meeting so that legal counsel can research this matter to determine if an ordinance is warranted. Aye’s: Feil, Green, Minzey and Sherlock. Nay’s: None. Motion approved. City Administrator/Treasurer Lonnie Miller reviewed the May 31, 2019 Financial Statements. Financial Statements are available for public inspection at the office of the City Clerk. City Administrator/Treasurer Lonnie Miller explained that Council Member Jerry Green is unable to continue to serve on the Panhandle Area Development District (PADD) Board of Directors due to personal scheduling conflicts and has submitted his resignation. Under the Panhandle Area Development District (PADD) bylaws, all members who pay their dues by December 31 may appoint a council member or professional staff to serve on the PADD Board of Directors. An alternative may also be appointed to attend meetings and vote in the absence of the primary board member. Council Member Jerry Green was selected to serve as PADD board member and Council Member Michael Minzey was selected an alternative member at the January 2019 council meeting. Moved by Green and seconded by Sherlock to appoint City Council Member Michael Minzey to serve as the City’s representative on the PADD Board. Aye’s: Feil, Green, Minzey and Sherlock. Nay’s: None. Motion approved. Moved by Sherlock and seconded by Green to appoint City Council Member Tyler Feil to serve as the City’s alternative representative on the PADD Board. Aye’s: Feil, Green, Minzey and Sherlock. Nay’s: None. Motion approved. City Administrator/Treasurer Lonnie Miller requested that a date be set for the budget workshop. It was recommended that the budget workshop be scheduled for Thursday, August 15, 2019, at 6:30 p.m. at the Housing Parrtners of Western Nebraska Community Room, 89A Woodley Park Road in the City of Terrytown. City Clerk Tamera Leeling will check for room availability with the Housing Partners of Western Nebraska and will place a notice in the Scottsbluff Star-Herald. Simmons Olsen Law Firm Representative Megan Dockery explained that a keno lottery agreement between the City and Operator Lucky One, LLC is needed to replace the previous agreement which expired on June 30, 2019. The City currently conducts a keno lottery and contracts with the Operator for the current operation of the Keno Lottery. The City and the Operator are entering into this agreement in order for the Operator to continue to operate the keno lottery. The term of this agreement would continue until June 30, 2024 unless terminated. The agreement would automatically be extended for an additional five years unless either party gives the other notice of termination at least 60 days prior to the expiration of the initial term. City Clerk/Office Manager Tamera Leeling reported that the creation of an alert system to notify residents of City notifications and emergency alerts has been requested. Ms. Leeling contacted Salt Creek Software, developers of the new water meter software program, but only a notification by email is available with the future system. Ms. Leeling contacted Tim Newman with Region 22 Emergency Management to discuss the possibility of the City using the Panhandle Alert system for their notifications. Panhandle Alert is the official emergency notification system used to communicate with community residents during emergencies. Mr. Newman has agreed to assist the City with notifications using the Panhandle Alert system at no cost to the City. Panhandle Alert allows its users to sign up to receive alerts by test message, email, voice message and on social media. This is a free service to users and information and instructions on how to register for the system will be included with the monthly utility statements for August, 2019, and will also be addressed in the City’s newsletter. City Administrator/Treasurer Lonnie Miller also reported that he had contacted the City of Bridgeport to determine what system they used and they advised that they use another vendor at a cost of $3,000.00 per year. Code Enforcement Officer Anne Reker presented an update on code enforcement efforts. Ms. Reker has been going door-to-door checking on weeds and notifying residents either in person or by leaving a door hanger at the residence. Ms. Reker has been explaining about whose responsibility it is to maintain the weeds in the alley as most residents are unaware of this ordinance. Most residents have been cooperative and understanding to Ms. Reker’s efforts to enforce the codes. Police Chief Kevin Spencer reported that the “Ask a Cop” program has been successful. Scottsbluff Police Corporal Krisa Brass responds to questions regarding law enforcement. The “Ask a Cop” section appears Monday on the City of Scottsbluff’s website (www.scottsbluff.org) and in the Tuesday edition of the Scottsbluff Star-Herald. Chief Spencer announced that the annual National Night Out will be held on Tuesday, August 6, 2019, from 6:00 p.m. to 8:00 p.m. and that Bands on Broadway is a six-week summer concert series held on Thursday. Chief Spencer advised that a police officer has been recently hired bringing the police department up to full strength. Panhandle Humane Society Animal Control Officer Virginia Klemm reported that two warnings and two follow-up letters were issued in June, 2019. The Panhandle Humane Society has been working with a resident on South Street to help reduce the number of feral cats that have habituated that area; two kittens were trapped that can be put up for adoption. Terrytown Resident Robert Ybarra addressed the council regarding lack of notifications regarding water shut-offs associated with the water project. Mr. Ybarra expressed concern over parking while the payment on Spring Valley Lane is torn up to allow contractors to replace water mains. Mr. Ybarra also discussed his concern over the proposed location for the placement of the water meter at his residence. Officer Manager/City Clerk Tamera Leeling advised that Assistant City Engineer Michael Olsen would contact Mr. Ybarra to discuss his concerns. Terrytown Resident Brian Nielsen addressed the council regarding his neighbor live-trapping squirrels while his other neighbor is raising squirrels inside his residence. Officer Manager/City Clerk Tamera Leeling advised that she had received a call about the live-trapping and contacted the Scottsbluff Police Department. Ms. Leeling was also contacted about the resident accused of live-trapping and was advised that there is an abundance of squirrels in the area which are causing damage to the trees. Ms. Leeling contacted the Panhandle Humane Society, Nebraska Game & Park Commission and Federal Wildlife Services Officer Matt Anderson, all who advised that they could not live-trap and relocate the squirrels to another location. Police Chief Kevin Spencer advised that he would research the situation. Mr. Nielsen also expressed concern about the weeds that are growing along the canal that passes through Terrytown. Code Enforcement Officer Anne Reker will notify the Central Irrigation District to resolve the weed problem. Mr. Nielsen also discussed his concern over the proposed location for the placement of the water meter at his residence. Officer Manager/City Clerk Tamera Leeling advised that Assistant City Engineer Michael Olsen would contact Mr. Ybarra to discuss his concerns. Office Manager/City Clerk Tamera Leeling reminded council of the Municipal Code Book Workshop on Thursday, July 25, 2019, at 6:30 p.m. at the Housing Partners of Western Nebraska Community Room, 89A Woodley Park Road in the City of Terrytown. There being no further business to come before the Council, moved by Sherlock and seconded by Feil to adjourn to the next called meeting on Thursday, August 1, 2019, at 6:30 PM, subject to the call of the Mayor.
