CITY OF TERRYTOWN
COUNCIL MINUTES
The City of Terrytown Council met on Thursday, June 1, 2017, at 6:30 PM, for their regular monthly meeting at the Housing Authority, 89A Woodley Park Road in the City of Terrytown.  Notice of said meeting was published in the Scottsbluff Star-Herald according to law and council members were notified of said meeting.  The meeting was called to order at 6:30 p.m. by Mayor Kent Greenwalt.  Council Members present were:  Cyinda Kriner and Marcia Sherlock.  Absent: Jerry Green and Chris Perales.  Assistant City Clerk Tamera Leeling recorded the proceedings of the meeting. The minutes of the previous meeting were dispensed with.
The Pledge of Allegiance was recited by those in attendance.  Mayor Greenwalt pointed out the location of the poster for the Open Meetings Act.
There were no additions, changes, or emergency items added to the agenda.
There was no correspondence added to the agenda.
Moved by Sherlock and seconded by Kriner to approve the minutes of May 4, 2017.  Aye’s:  Greenwalt, Kriner and Sherlock.  Nay’s:  None.  Motion approved.

Mayor Greenwalt requested the appointment of Cindy Rein and Linda Green-Perez to the City of Terrytown’s Board of Health.  A Board of Health meeting will be conducted on Thursday, June 8, 2017, at 6:30 PM at the Housing Authority, 89A Woodley Park Road in the City of Terrytown.  Moved by Sherlock and seconded by Kriner.  Aye’s:  Greenwalt, Kriner and Sherlock.  Nay’s:  None.  Motion approved.
Mayor Greenwalt requested the appointment of Keven Smith to the City of Terrytown’s Board of Adjustment.  Moved by Kriner and seconded by Sherlock.  Aye’s:  Greenwalt, Kriner and Sherlock.  Nay’s:  None.  Motion approved.
City Engineer Jeff Wolfe provided an update on the water project.  A pre-construction meeting with Hennings Construction, Inc. needs to be scheduled.  A construction schedule should be available for the July Council Meeting.  The contracts have been signed and are in place except the USDA still needs to sign the contract with Hennings Construction, Inc.  The meter project (Phase 2) will probably be bid out in the late fall.
City Engineer Jeff Wolfe reported on the proposed property acquisition from Terry Carpenter, Inc.  Parameters need to be established if Special Attorney Jim Ellison is to negotiate with Terry Carpenter, Inc.  If Mr. Ellison acts as the city’s agent, City Engineer Jeff Wolfe or City Administrator Lonnie Miller will work with him.  City Attorney Libby Stobel and Special Attorney Jim Ellison will discuss guidelines prior to the next City Council Meeting. If TCI has interest in negotiating, the City would like to move forward as quickly as possible on this matter, as it needs to begin budget preparation for the next fiscal year. In addition, the existing lease with TCI on Terry’s Lake will expire at the end of February, 2018, so if the purchase is not moving forward, the City will need to discuss a new lease.
City Engineer Jeff Wolfe reviewed the pending Terrytown Storm Water Management Program.  The City is required to develop a storm water management program as part of the Federal Clean Water Act.  Scottsbluff has been required to have a plan in place for approximately twelve years and may be able to assist Terrytown and Gering to develop their programs.  There is a probability that Terrytown could obtain a co-permit with Gering.  Terrytown’s water lines run with Gering and other services needed for maintenance are contracted with Scottsbluff so it is our intent to work with both cities.  It will take approximately eighteen months to have a plan and ordinances in place.  This is a federally unfunded mandate as there are no grants or funds available.  A surcharge will need to be implemented to assist in funding and maintaining a program.  Scottsbluff requires a $1.25 per month surcharge. It is recommended that Terrytown mirror this charge the same so that all community residents will pay the same rate.
City Administrator/Treasurer Lonnie Miller presented the April 2017 Financial Statements.    
City Administrator/Treasurer Lonnie Miller discussed the continuation of a $250.00 monthly contribution to the Carpenter Center through keno funds.  Moved by Sherlock and seconded by Kriner to continue the $250.00 contribution to the Carpenter Center as long as funds will allow.  Aye’s:  Greenwalt, Kriner and Sherlock.  Nay’s:  None.  Motion approved.
Office Manager Tamera Leeling proposed the purchase of a new paper folding machine for the City Office to replace the existing machine.  The current machine is malfunctioning and parts are no longer available to service it.  Ms. Leeling proposed the purchase of the Formax FD 300 Paper Folding Machine from Staples for $537.59 less $30.00 coupon and free shipping to the Scottsbluff Staples for a total of $507.59.  This machine is similar to the current machine and provides the necessary functions for the City’s requirements.  Moved by Sherlock and seconded by Kriner to purchase the Formax FD 300 Paper Folding Machine from Staples for $507.59.  Aye’s:  Greenwalt, Kriner and Sherlock.  Nay’s:  None.  Motion approved.

City Attorney Libby Stobel discussed Resolution 17-2 which modifies the City’s policy regarding reasonable advance publicized notice to reflect publication in the Scottsbluff Star-Herald.  The former resolution had the Gering Courier as newspaper of record for publications.  The Gering Courier is no longer utilized by the City, as publication occurs in the Scottsbluff Star-Herald.  Moved by Sherlock and seconded by Kriner to approve Resolution 17-2.  Aye’s:  Greenwalt, Kriner and Sherlock.  Nay’s:  None.  Motion approved.

RESOLUTION NO. 17-2
    BE IT RESOLVED by the Mayor and the Council of the City of Terrytown, Nebraska, a municipal corporation:
    1.    The City of Terrytown has in place a policy in which it gives reasonable advance notice to all regular meetings and special meetings held by the Council. The purpose of this Resolution is to memorialize the method designated by the Council and to record it in the minutes.
    2.    The time and place for regular meetings of the Council is set forth in Ordinance #333. Reasonable advance notice of these meetings is published in the Scottsbluff Star-Herald at least ten days prior to the regular meeting, setting forth the fact that a meeting will be held, where and when the meeting will be held, and further setting forth an agenda of subjects known at the time of the publicized notice or a statement that the agenda, which shall be kept continually current, will be readily available at the City office during normal business hours.
    3.    In regard to any other meetings held by the Council, reasonable advance notice will include publishing in the Scottsbluff Star-Herald, if there is a time to do so. If the time for publication is too short for the meeting, then notice of the meeting will be posted in three conspicuous places within the City, including the City office. The notice will advise where and when the meeting will be held, set forth an agenda of subjects for the meeting or a statement that the agenda, which shall be kept continually current, will be readily available at the City office during normal business hours.
    4.    This Resolution shall become effective upon its passage and approval.

Police Chief Kevin Spencer presented an update on police activities.  The Civil Service Commission recently tested for a patrol officer.  Seven candidates are on the eligibility list and one of those candidates will be hired to fill a vacant position. Three site visits have been performed for the Computer Aided Dispatch and Records Management System.  It has been narrowed to two vendors and they have been invited back to answer questions.  The new program should be live within 12-18 months.

During the public comment time, Johnny Zhao, owner of the Tea Garden Restaurant, brought up that the adjacent property owner has installed a new drain system that causes storm water run-off from to now flow into the Tea Garden Restaurant’s parking lot and across their sidewalks creating a safety concern.  City Engineer Jeff Wolfe and Assistant City Engineer Michael Olsen reviewed the situation and due to lack of a city ordinance regulating storm water, Mr. Zhao was advised that he may want to contact a private attorney to address this civil matter.
There being no further business to come before the Council, moved by Sherlock and seconded by Kriner to adjourn to the next called meeting on Thursday, July 6, 2017 at 6:30 PM, subject to the call of the Mayor.  Aye’s:  Greenwalt, Kriner and Sherlock.  Nay’s:  None.  Motion approved.
