CITY OF TERRYTOWN
COUNCIL MINUTES
  
The City of Terrytown Council met on Thursday, May 2, 2019, at 6:30 PM, for their regular meeting at the Housing Partners of Western Nebraska Community Room, 89A Woodley Park Road in the City of Terrytown.  Notice of said meeting was published in the Scottsbluff Star-Herald according to law and council members were notified of said meeting.  The meeting was called to order at 6:30 PM by Mayor Chris Perales.  Council Members present were:  Tyler Feil, Jerry Green, Michael Minzey, Chris Perales and Marcia Sherlock.  Absent:  None.  City Clerk Tamera Leeling recorded the proceedings of the meeting.  The minutes of the previous meeting were dispensed with.

The Pledge of Allegiance was recited by those in attendance.  Mayor Perales pointed out the location of the poster for the Open Meetings Act.

There were no additions, changes, or emergency items added to the agenda.

Adjustments to the minutes of the regular meeting of April 4, 2019, need to be made on Page 2/Paragraph 3/Line 4, Page 3/Paragraph 1/Line 4, Page 3/Paragraph 7/Line 12 and Page 4/Paragraph 1/Line 2 to include rewording.  Moved by Green and seconded by Feil to approve the minutes of the regular meeting of April 4, 2019, with amendments.  Aye’s:  Feil, Green and Minzey.  Nay’s:  None.  Motion approved.

Moved by Sherlock and seconded by Green to approve Contractor’s Application for Payment No. 3 to Hennings Construction, Inc. regarding Terrytown’s Water System Project Phase III:  Meter Project in the amount of $164,693.29 pending agency concurrence.  Aye’s:  Feil, Green, Minzey and Sherlock.  Nay’s:  None.  Motion approved. 

City Administrator/Treasurer Lonnie Miller reviewed the March 31, 2019 Financial Statements.  Financial Statements are available for public inspection at the office of the City Clerk. 
 
City Administrator/Treasurer Lonnie Miller discussed providing AirMedCare Network Membership to City employees.  In the event of a major medical emergency and an employee would be required to be flown, AirMedCare will accept the amount from the insurance company’s payment without requesting any additional money from the member. The City qualifies for the “Business Gift” plan which allows employers with less than 25 employees to purchase memberships for their employees for $65.00 per employee and to pay directly with one check.  Moved by Sherlock and seconded by Minzey to provide AirMedCare Network Membership for $65.00 per employee for the City’s three full-time employees (Hugo Chairez, Tamera Leeling and Dennis McLaughlin).  Aye’s:  Feil, Green, Minzey and Sherlock.  Nay’s:  None.  Motion approved. 

City Administrator/Treasurer Lonnie Miller discussed appointing Mayor Chris Perales to replace Former Mayor Kent Greenwalt as representative on the Scotts Bluff County Mutual Financial Organization (MFO).  This program allows applications to be submitted to the state for funding through their organization.  All Scotts Bluff County fire districts belong to the MFO.  Terrytown is covered by the Scottsbluff Rural Fire District so a City representative is needed to serve on their board.  Moved by Sherlock and seconded by Feil to approve Chris Perales to replace Kent Greenwalt as Terrytown’s representative to the Scotts Bluff County Mutual Financial Organization (MFO).  Aye’s:  Feil, Green, Minzey and Sherlock.  Nay’s:  None.  Motion approved.
 
City Administrator/Treasurer Lonnie Miller reported that Robert Blanco, Jr. has been hired for the City’s seasonal parks maintenance employee position, a position he has held for the past three summers. Mr. Miller explained that Mr. Blanco’s start date was effective as of April 1, 2019, and proposed a rate increase of 25 cents per hour which brings the rate of pay to $10.40 per hour.  Moved by Green and seconded by Sherlock to approve the hiring of Robert Blanco, Jr. as a seasonal employee effective April 1, 2019, at a pay rate of $10.40 per hour.  Aye’s:  Feil, Green, Minzey and Sherlock.  Nay’s:  None.  Motion approved.

City Engineer Jeff Wolfe presented an update on the Terrytown Water Project.  Hennings Construction began the water meter installation on Country Club Road.  Installation is going smoothly with only a few weather delays.  The contractor has been cutting sod, installing the meter and back-filling within a timeframe of 2-3 hours per meter.  Residents are receiving notices a few days prior to the meter installation at their residence.  A progress meeting with the contractor is scheduled for Friday, May 3, 2019. 
 
City Engineer Jeff Wolfe explained that at last month’s meeting, Terrytown Resident Brian Nielsen requested a streetlight be placed on the power pole located in his backyard.  The power pole was placed in his yard to support Nebraska Public Power District’s (NPPD) powerlines.  Mr. Nielsen explained that the streetlight would benefit three residences by providing light in an area that has no present streetlight and that is covered in darkness.  Mr. Nielsen’s residence faces Woodley Park Road and the back faces Spring Valley Lane with no alley in between.  NPPD Employee Chuck Vacca examined the pole and advised that it is too low and too far from the street to warrant a streetlight.  Mr. Vacca also advised that sufficient lighting is provided without an additional streetlight in that area.  Mr. Wolfe suggested two options for the lighting situation:   1) The resident could request a standard yard light be placed on the pole and be charged $8.50 per month or 2) The City could request a streetlight be placed near the intersection of Woodley Park Road and Spring Valley at a utility cost of $10.11 per month.  Mr. Wolfe explained that NPPD’s concerns are that a street light might provide excessive light for neighbors creating unsafe driving conditions.  Mr. Wolfe requested that this agenda item be tabled until the June 2019 meeting to allow Mr. Nielsen to discuss the matter with his wife and to allow neighbors to present their concerns about the option of a streetlight.
 
City Engineer Jeff Wolfe explained that due the changes in the sewer cleaning agreement with the City of Scottsbluff, routine sewer cleaning will need to be performed by an independent contractor.  Mr. Wolfe requested that this agenda item be tabled until the June 2019 meeting to allow more time to solicit proposals for routine sewer cleaning services.
 
City Attorney Libby Stobel presented Ordinance No. 449 which pertains to the development of the City’s Stormwater Pollution Prevention Plan.  This ordinance would regulate land disturbance activities to control soil erosion, set requirements for a stormwater prevention plan, and define terms, set conditions for a permit and enforcement of the permit.  Ms. Stobel advised that since the City of Scottsbluff has not yet signed the Interlocal Agreement for a stormwater facility and outfall inspections and the amount of the initial fee has not been determined, therefore, a correction needs to be made to Paragraph 7 under “Application; Fees”.  Ms. Stobel suggested tabling these two agenda items, Ordinance No. 449 and the Interlocal Agreement, until the June 2019 meeting at which time the agreement with Scottsbluff may be signed and fees determined.  Moved by Sherlock and seconded by Green to table Ordinance No. 449 to the June 2019 City Council Meeting.  Aye’s:  Feil, Green, Minzey and Sherlock.  Nay’s:  None.  Moved by Sherlock and seconded by Feil to table the Interlocal Agreement with the City of Scottsbluff for Stormwater facility and outfall inspections.  Aye’s:  Feil, Green, Minzey and Sherlock.  Nay’s:  None.  Motion approved.
 
City Attorney Libby Stobel explained that the City reviews its cable franchise agreements every ten years, including one with Charter which will expire in 2020.  Ms. Stobel discussed draft Ordinance No. 450 which deals with cable television systems and the issuance of franchises to operators of cable television systems and allowing for the use of rights-of-way for cable television systems.  Since a community junction box, a franchise building to make payments and the same system is used by the cities of Scottsbluff and Gering and Scotts Bluff County, essentially the same agreement is utilized by all unless specific specifications are required.

City Attorney Libby Stobel presented a job description created by the Code Enforcement Officer Committee for a proposed code enforcement officer position.   The committee requested that the job description be adopted and that the position be posted.  Police Chief Kevin Spencer has offered the assistance of the Scottsbluff Code Enforcement Officer for an initial training period and City Attorney Libby Stobel will help with prosecution processes.  This will be a seasonal position from April to October.  From November through March, this will be a “as needed, on-call’ basis position.  The Code Enforcement Officer will share office space and equipment with the City’s Utilities/Maintenance Department.  Moved by Feil and seconded by Minzey to approve the City Code Enforcement Officer job description and posting.  Aye’s:  Feil, Green, Minzey and Sherlock.  Nay’s:  None.  Motion approved.
 
City Attorney Libby Stobel reported that a committee has been formed and has met several times to review the proposed Municipal Code Book.  Ms. Stobel suggested that Council conduct a public workshop to review recommended changes prior to the book being forwarded to Municipal Code Book Services for finalization.  The public workshop will be held on Thursday, June 20, 2019, at the Housing Partners of Western Nebraska Community Room, 89A Woodley Park Road in the City of Terrytown at 6:30 p.m.
 
Office Manager Tammy Leeling explained that Power Manager works with Salt Creek Software, Inc. to design the particular software required to be used with the water meters installed during the water project.  Salt Creek Software, Inc. creates software to meet each city’s specific needs.  Salt Creek Software, Inc. has the capability to perform a conversion of the existing utilities billing data to the new software being developed saving Ms. Leeling from manually entering the information.  The cost of the conversion will not exceed 5 hours at $130.00 per hour or $650.00 total; this amount does not include any applicable sales tax.  Moved by Sherlock and seconded by Feil to approve Salt Creek Software, Inc. to perform the conversion of existing utility billing data to new water meter software for $650.00 plus any applicable sales tax.  Aye’s:  Feil, Green, Minzey and Sherlock.  Nay’s:  None.  Motion approved.
 
City Representative Kent Greenwalt presented an update on the meetings he attended on behalf of the City during the past month for Nebraska Public Power District, Scotts Bluff County Mutual Finance Organization, Foster Grandparents and Region 22 Emergency Management. 
 
Police Chief Kevin Spencer reported that the annual report for activity in Terrytown for the period of January 1, 2019 through April 30, 2019 indicated that officers responded to a total of 227 calls; an average of 50 calls per month.  A memorial service for fallen officers will be held on Thursday, May 16, 2019, at 11:00 a.m. at the Scottsbluff Police Department.  Chief Spencer also reported that testing for a police officer was held.  Out of the 22 applications received, 17 were invited to be tested, 14 tested and it was narrowed down to 8 candidates.  The police department is hoping to add a K-9 to the department in the near future.  The police department has been working with the Scottsbluff Star-Herald to develop an “Ask A Cop” program.       
 
Terrytown Resident Brian Nielsen addressed the Council regarding his neighbor’s dead tree that has been in his yard for the past five years.  City Attorney Libby Stobel advised that she would contact Mr. Nielsen with an update on the situation.  Mr. Nielsen also address the Council regarding excessive weeds and garbage in the ditch that runs through Terrytown.  City Engineer Jeff Wolfe will contact ditch rider from the Central Irrigation District concerning the excessive growth and garbage.
 
Mayor Chris Perales reported that the cities of Gering, Scottsbluff, Mitchell, Terrytown and Scotts Bluff County hosted a news conference on May 2, 2019, where the Mayors and Board Chairman signed a Proclamation declaring May 2nd as a Day of Prayer for our communities and our nation.  The event took place in conjunction with National Day of Prayer activities occurring all over the United States. 
 
There being no further business to come before the Council, moved by Sherlock and seconded by Minzey to adjourn to the next called meeting on Thursday, June 6, 2019, at 6:30 PM, subject to the call of the Mayor.  Aye’s:  Feil, Green, Minzey and Sherlock.  Nay’s:  None.  Motion approved.
